Literally, it is a question of which manufacturer's load center the sub-panel is being derived from.

Some manufacturers, Square D [QO line] for example, have a 200 amp breaker, QO2200BB, that can be installed in the panel as a branch breaker. This would theoretically allow you to install a 200 amp sub-panel in the apartment.

You need to calculate the load for the apartment and size your branch breaker accordingly.

Remember that the neutral has to be isolated from the ground buss in the sub-panel.
