The Legalist Paradigm (the international Just War theory created by Walzer) is based upon a system in which there is an international order of laws that govern the relations of states. This has been commonly expressed through the use of the United Nations or the International Criminal Court. However, as there is no strong, cohesive international legal system, it has never been truly applied. The legalist paradigm is only possible if all nations agree to be bound by the same code of international law, which would feasibly act in the same way a national legal system does in maintaining order. Domestically, any government with a governing document based upon law is a legalist government. This includes the United States and any other state with a constitution that remains the highest law in the nation.
