An offer has to be accepted first to create a legal obligation (I'm not a real estate expert, but this is basic contract law and if you read real estate blogs, offers are ignored all the time even if they are at or above asking price. Remember also price is only one component of the offer. The seller will offer consider financing and contigencies as well. It is common for home sellers to refuse higher offers and accept lower offers when the lower offer is cash or otherwise has a better chance of succeding vs. financing that may fall through )
