No, this is an unacceptable swap. It is never advisable to go over 3% difference in diameter. The 265 tire is 5.4% or 1.65" larger in overall diameter. Your speedometer will read 56.7 at a true 60 mph. Handling, power, fuel mileage, & ride will be adversely effected. Stick with the OEM size that was chosen by the manufacture or you can install a set of 255/65-16 which is an acceptable and very good swap. Just make sure you have no clearance issues. As someone else posted it is not illegal to install this tire but it is also not good judgment. Of course you can do it, no one will stop you but, No expert in the field of tires would recommend this as a good swap, no matter what anyone tells you. In fact this is a horrible swap at 5.4% difference in sizes.

If your OEM size is 235/70-16 and you want to go to a 75 series tire then you need to install a 215/75-16. If your OEM size is 245/75-16 and you want to go to a 70 series tire then go with a 265/70-16.
