As with any probate estate, it would depend on any number of other issues, including the actual words of the grant of ownership (jointly, in common), then (assuming common ownership) whether there was a valid will of the other party and what the will says about property rights, and if no will, then where the person was domiciled when he or she died and what their laws of intestacy have to say, and if any heirs can be found, and if you can negotiate with the heirs, and so forth.

If, for example, you were named on a deed as "A and B", and B dies, then B's share passes to his or her heirs, whoever they are. If there is a will that gives the rights to A, then obviously A now has all the mineral rights, which would be exactly the same as if the deed had said "A and B as joint tenants with right of survivorship," although the estate tax issues may be different.

Ownership cannot be changed after death. All rights and responsibilities of the owner of the policy end at death of the insured. How do I find inherited mineral rights when there is no will?

You need to contact an attorney who specializes in probate law in your jurisdiction. The attorney will need to have a professional examine the title to the purported rights in the land records to determine if the decedent owned those rights at the time of death. Then it will have to be determined if you are a legal heir at law.

When a mother and daughter own a home as joint tenants with full rights to survivorship and the mother passes away is there a transfer of ownership in the state of MI?

That type of ownership of anything anywhere means exactly that.Joint Tenancy with Right of Survivorship (JTWROS) at death of any party their rights vest in the remaining party(s). (Can be several owning together this way, with the last living one essentially "winning" and owning it all). While the ownership change happens, to make sure the world knows that it has, some process with the local property recorders office, likely providing a death certificate or such, should be done to essentially remove the deceased persons name from the title.

Can mineral rights from estate be passed on to heirs through probate immediately following the demise of the owner?

In the United StatesMineral rights are attached to and run with the real estate. Although equitable title to real property passes to heirs immediately upon death, generally, the estate must be probated in order for legal title to pass to the heirs. That means the heirs cannot legally sign a deed or contract to sell or lease mineral rights until the estate has been probated.

What is the best way to deed over mineral rights prior to death?

It's best to search the deed records to determine the legal description of the mineral interest. You do that by going to the county of the mineral interest and search the index by the owner's name. Use that legal description to insert into a mineral deed, have it signed before a notary public, and record it in the deed records of the relevant county. in addition: "By conveying the mineral rights over by means of a mineral deed or quit claim deed and then file it with the county clerk or recorder in which the tract or tracts lay. A mineral deed or quit claim deed can be purchased for very little cost online or at a office supply store"
