The United States Postal Service is not a privately run agency, it is an independent establishment of the executive branch of the United States Government (39 U.S.C. § 201). The Office of the President of the U.S. is responsible for the appointment of nine members of the Board of Governors of the United States Postal Service. All Governors declare affiliation with a political party and no more than five of the nine sitting Governors may belong to the same party. Once the nine appointees are confirmed by the Senate, they serve a nine year term (the terms are staggered so that one Governor steps down every year). These nine Governors select a Postmaster General who sits on the board with them. The now ten member board chooses a Deputy Postmaster General to serve as the eleventh member of the board. As a quasi-governmental agency, the USPS is granted special privileges, including sovereign immunity, eminent domain powers, powers to negotiate postal treaties with foreign nations, and an exclusive legal right to deliver first-class and third-class mail...and they still managed to lose $3.8 billion last year.
